Overview
Amplify Real Estate Services ("Amplify," "we," "us") respects the intellectual property rights of others and expects users of amplify-re.com (the "Site") to do the same. This policy explains how to report claimed copyright infringement and how we respond, in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
1. Reporting Claimed Infringement
If you believe content available on the Site infringes a copyright you own or control, you may send a written notification to our designated agent that includes all of the following:
- —A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
- —Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works at a single online location are covered by a single notification.
- —Identification of the material claimed to be infringing, and information reasonably sufficient to let us locate it on the Site (e.g., a specific URL).
- —Your contact information, including an address, telephone number, and email address.
- —A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- —A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
Notices that don't include all of these elements may not receive a response, consistent with 17 U.S.C. § 512(c)(3).
2. Designated Agent
Please send infringement notices to our designated DMCA agent:
Kyle James Nash / Owner
Amplify Real Estate Services
1311 N Washington St, Suite A, Spokane, WA 99201
Email: dmca@amplify-re.com
This agent is registered with the U.S. Copyright Office's Designated Agent Directory at dmca.copyright.gov (Registration ID: DMCA-1079349).
3. Counter-Notification
If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to the designated agent above that includes:
- —Your physical or electronic signature.
- —Identification of the material that was removed or disabled, and its location on the Site before removal.
- —A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- —Your name, address, and telephone number, and a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Amplify may be found), and that you will accept service of process from the person who filed the original notice or their agent.
Upon receiving a valid counter-notification, we may, in our discretion, restore the material within 10–14 business days unless the original complaining party first files a court action seeking a restraining order, consistent with 17 U.S.C. § 512(g).
4. Repeat Infringer Policy
We will, in appropriate circumstances and at our discretion, disable or terminate the accounts of users who are determined to be repeat infringers.
5. No Legal Advice
This policy describes our process for responding to copyright complaints under the DMCA; it is not legal advice, and submitting or receiving a notice does not create an attorney-client relationship. If you are unsure whether material infringes your copyright, or whether your use of material is authorized, consider consulting an attorney.
6. Changes to This Policy
We may update this policy from time to time. The date above reflects the version you're viewing.
